This workshop is an inaugural course of AAIL’s new series on Investment Law. It aims to introduce the main features of International Investment Agreements (IIAs) and arbitration using a mock case. The first session is dedicated to an introduction to the Vienna Convention on Law of Treaties and IIAs. The latest developments and trends in investment treaty practice will be discussed. Importantly, participants will gain insight into the current contours of core substantive provisions of IIAs, such as fair and equitable treatment, full protection and security, protection against unlawful expropriation and non-discrimination obligations. The second session will focus on investor-state arbitration under the ICSID Convention and other dispute resolutions mechanisms. Participants will be familiarised with special aspects of investor-state arbitration proceedings and enforcement of the arbitral award.

This talk is the second course of AAIL’s 2018 series on Investment Law. Matthew Hodgson will make a presentation on his latest study concerning the practice of investment treaty arbitrations, which includes an analysis of its costs, the length of the arbitration process, success rates, the apportionment of costs by tribunals and amounts recovered. The current study interprets data from a total of 324 publicly available awards and 52 annulment decisions. It is a comprehensive update of Matthew's original 2012 study. The talk will be moderated by Romesh Weeramantry.

The Korean Commercial Arbitration Board (KCAB) is holding the 6th FDI Moot Asia-Pacific Regional Rounds with Center for International Legal Studies (CILS) and Seoul National University School of Law.


Increasing international investment, the proliferation of international investment treaties and contracts have contributed to the development of international law that defines obligations between host States and foreign
investors and refers to internationalized arbitration procedures for resolving related disputes. The FDI Moot addresses such investment disputes.
