In this presentation, His Honour Judge David Waksman QC, Judge in Charge of the London Mercantile Court, who also sits in the English Commercial Court, will offer some perspectives on litigation funding in arbitrations, particularly in the light of his decisions in Essar v Norscot (arbitrator's power to award funding costs against losing party) and Impact Funding v AIG (insurance cover for solicitor's liability to funder). He will also speak about the autonomy of arbitration and its relation to the development of the law.
