Fees

 

Administered Arbitration

In cases in which parties have agreed to have their arbitration administered in accordance with the HKIAC Administered Arbitration Rules ("the Rules"), a registration fee of US$1,000 shall be submitted to the HKIAC Secretariat with the Notice of Arbitration or counterclaim made by any Respondent.

The HKIAC's administrative fee shall be charged in accordance with Section 2 of the Schedule of Fees and Costs of Arbitration ("the Schedule") attached to the Rules.

The arbitral tribunal's fees shall be determined, at the option of the parties, either (a) in accordance with Section 3 of the Schedule or (b) in accordance with the fee arrangements agreed to between the appointing party or parties and the arbitrator so appointed (and, in the case of the third arbitrator in a three-member tribunal, between the parties and such third arbitrator).

Parties shall notify the HKIAC Secretariat their decision as to the method for determining the arbitral tribunal's fees within 30 days from the date of the Notice of Arbitration. Where the Schedule applies, the tribunal's fees shall be fixed by the HKIAC Council.

Where the parties fail to agree on the method for determining the arbitral tribunal's fees by such date, the fees shall be determined in accordance with the fee arrangement agreed between the appointing party or parties and the arbitrator so appointed.

Ad hoc Arbitration

At the request of either party (or both parties) in an ad hoc arbitration, the HKIAC may (1) appoint arbitrator(s) or umpire(s); and (2) determine the number of arbitrators. The fee for appointing one arbitrator is HK$4,000, and the fee for determining the number of arbitrators is HK$4,000.

The arbitral tribunal's fees shall be determined in accordance with the fee arrangement agreed between the appointing party or parties and the arbitrator so appointed.
