HKIAC 推出知識產權爭議仲裁員名冊

香港國際仲裁中心 ("HKIAC") 現已正式推出 《知識產權爭議仲裁員名冊》 (“《名册》”)。 《名冊》包括了眾多在處理知識產權 ("IP") 案件方面具有豐富經驗的國際知名專家。 

《名冊》目前有 30 名成員。他們通曉 7 種語言、在 12 個國家和地區執業。有的成員不僅是經驗豐富的仲裁員，還是資深大律師、前任法官或 IP 專業組織的負責人。這些仲裁員加起來在 IP 領域擁有超過 850 年的經驗，處理過各種 IP 事務，包括許可問題、侵犯版權、FRAND 爭議以及專利、商標和設計的注冊等等。

《名冊》獨立於 HKIAC 的常規仲裁員名冊和名單，並將成為 HKIAC 在 IP 案件中指定仲裁員的主要來源。該《名冊》還可為當事人在 IP 糾紛中仲裁員的提名和選擇上提供參考。
 
《名冊》的出台恰逢香港特區政府公布再次更新 《仲裁條例》（第609章）的咨詢文件。  此次更新的主要目的在於確定與 IP 權利的存在、范圍、效力、權限、侵犯有關的或其他相關方面的爭議可在香港提交仲裁解決，且執行有關 IP 權利的仲裁裁決將不違背香港的公共政策。這一修改意見証明了香港致力於將自己打造成為全球 IP 爭議解決中心和亞太 IP 貿易中心的決心。 香港在這一領域的優勢體現在其現代化的法律基礎、公正獨立的司法體制、健全的 IP 權利保護機制以及大量通曉多種語言的 IP 行業和爭議解決專家。

基於上述優勢，HKIAC 條款常常出現在 IP 許可協議中。HKIAC 還見証了越來越多的相關爭議提交到 HKIAC 進行仲裁。作為亞洲頂尖的網上爭議解決中心，HKIAC 每年收到的域名爭議案件持續增長。2015 年, HKIAC 處理了 227  起此類案件，與 2014 年相比提升了 13%。《名冊》的推出進一步加強了 HKIAC 處理 IP 爭議的能力並擴大了其處理的 IP 案件的范圍。

Quinn Emanuel Urquhart & Sullivan 香港辦公室執行合伙人及該所亞洲國際仲裁業務主管 John Rhie 先生談到 “our firm is well known for its expertise in IP disputes and through that I have been able to personally witness a real growth in the number of such disputes, such as FRAND disputes, being handled through international arbitration. The twin initiatives by the HKIAC and the Hong Kong Government continue to put Hong Kong at the forefront of this change and is most welcome for users and practitioners alike”。
 
英國上訴法院前任法官、倫敦大學學院 IP 法教授Robin Jacob 閣下稱《名冊》為 “a very important and welcome development”。他還提到 “IP disputes can be contractual (particularly license disputes) but also non-contractual. Rather than using the courts, IP disputes – especially international disputes - can be efficiently resolved by specialist tribunals. HKIAC has assembled a panel for these very purposes. Sensible parties will use HKIAC as the nominated arbitral panel in IP licensing contracts and those who have disputes should consider agreeing to have their dispute(s) resolved by a HKIAC arbitration”
