Chasing the Money: Part One Pre-dispute asset tracing
Today the global economy is more closely intertwined than ever before, with parties taking advantage of free movement of capital to easily transfer assets across jurisdictions. The ability to "chase the money" is all the more important, especially in cross-border dispute resolution proceedings involving multiple legal systems, parties and complex corporate structures.
The first of this two part seminar* will provide a comprehensive overview of how asset tracing can be used to shape a dispute resolution strategy at the early stages, and equip participants with the tools to make sound business decisions when faced with a dispute.

The 5th FDI Moot Asia-Pacific Regional Rounds

The Korean Commercial Arbitration Board (KCAB) is holding the 5th FDI Moot Asia-Pacific Regional Rounds with Center for International Legal Studies (CILS) and Seoul National University School of Law.
Increasing international investment, the proliferation of international investment treaties and contracts have contributed to the development of international law that defines obligations between host States and foreign investors and refers to internationalized arbitration procedures for resolving related disputes. The FDI Moot addresses such investment disputes.
The 2017 FDI Moot case considers how Mercuria, a State faced with a “greyscale” epidemic, has treated a foreign investor, patent-holder of the active ingredient in an effective greyscale treatment, by first breaching a supply agreement, which was the basis for the investor’s production facility investments in Mercuria, and failing to enforce the consequent arbitration award and by then granting a compulsory license to a state-owned manufacturer.

Adjudication Short Course

With the introduction of Adjudication in the proposed Security of Payment Legislation in Hong Kong. Adjudication is set to become the "first-tier" dispute resolution method in construction contracts. Risky business: political risk insurance in OBOR jurisdictions
HKIAC is pleased to host and support the International Law Lecture Series organised by CMS.
Investment in emerging markets along OBOR jurisdictions is risky, including within Asia. Some of the jurisdictions suffer from political instability, lack of security, regulation or infrastructure, the absence of a fair and impartial legal system, poor corporate governance and inconsistent adherence to the rule of law. These risks raise investment costs and may deter investment altogether. The World Bank Group, through its Multilateral Investment Guarantee Agency (MIGA), has been navigating the complex world of political risk in Asia for decades, and has designed political risk insurance policies to hedge against these risks.Read more
