HKIAC and Skadden, Arps, Slate, Meagher & Flom are pleased to bring you this discussion on third party funding. In this presentation, His Honour Judge David Waksman QC, Judge in Charge of the London Mercantile Court, who also sits in the English Commercial Court, will offer some perspectives on litigation funding in arbitrations, particularly in the light of his decisions in Essar v Norscot (arbitrator's power to award funding costs against losing party) and Impact Funding v AIG (insurance cover for solicitor's liability to funder). He will also speak about the autonomy of arbitration and its relation to the development of the law.

2017 HK Practice Moot
HKIAC is pleased to host the HK Practice Moot for the 10th Frankfurt Investment Arbitration Moot Court. The HK Practice Moot is the only Asian practice moot for the Frankfurt Investment Arbitration Moot, providing teams in the Asia-Pacific region experience in the practice of investment arbitration in simulated arbitration hearings.

Based on newly-released empirical findings, Professor Affaki will explore in his lecture the reality of arbitration in banking and financial matters. He will make the case for a differentiated approach according to the particular banking sector where arbitration is contemplated, including derivatives, project finance, advisory banking, sovereign lending, and Islamic finance and offer recommendations that take into account the reality of banking and finance in the wake of the Global Financial Crisis and the risk approach in international banks towards commercial and investment arbitration.

Domain Name Dispute Resolution Conference

HKIAC Arbitrator Training Series - Beijing
Arbitration laws and rules routinely provide for a mechanism to challenge arbitrators. While challenges to arbitrators are, at least in Hong Kong arbitration, not often sustained, any challenge made will disrupt proceedings, add delay and increase costs. Every arbitrator should, therefore, be keeping pace with the international standards and latest practice relevant to potential conict of interests, duties of disclosure, typical challenge allegations and related procedures.
This training will provide practical and informative insights into the latest developments in this area, with reference to the relevant practice at HKIAC and in Hong Kong-seated arbitration.
