HKIAC Arbitrator Training Series
Arbitration laws and rules routinely provide for a mechanism to challenge arbitrators. While challenges to arbitrators are, at least in Hong Kong arbitration, not often sustained, any challenge made will disrupt proceedings, add delay and increase costs. Every arbitrator should, therefore, be keeping pace with the international standards and latest practice relevant to potential conict of interests, duties of disclosure, typical challenge allegations and related procedures. This training will provide practical and informative insights into the latest developments in this area, with reference to the relevant practice at HKIAC and in Hong Kong-seated arbitration. The participants will also have an opportunity to exchange views with the trainers on practical issues arising from two real-life challenge scenarios.

Most international arbitration rules confer on the Tribunal a very wide discretion as to whether costs should be awarded, to whom and in what amount. As claims for costs get larger this discretion becomes onerous. This Lecture aims to shed light on the origin of the principles underlying the allocation of the costs decision process and the major trends in international commercial and treaty arbitrations.
