HKIAC Tribunal Secretary Training Programme - Hong Kong
HKIAC is the first arbitral institution to offer a Tribunal Secretary Training Programme. As an extension of HKIAC’s tribunal secretary service, the Programme trains the next generation of tribunal secretaries around the world.
The training is two-and-a-half-day, during which part of the participants work will be assessed. A further written exam will follow the training. Participants who have passed the written exam will receive a certificate of completion and will be listed on our website subject to his/her consent.

Maximising Recovery in International Infrastructure Disputes
This workshop brings together legal counsel, an asset recovery specialist, and a third-party funder in an early stage meeting scenario to consider the legal options available and practical steps required to formulate an effective dispute resolution strategy.
Experts will consider the lifecycle of a dispute from commencement of proceedings through to enforcement and ultimate recovery. The aim is to equip attendees with the tools to make sound business decisions when faced with a dispute arising out of an infrastructure project.

Cross-Sector Mediation Forum
Unbeknown to many accredited mediators in Hong Kong, different private sectors and institutional/special sectors have their own selection criteria in appointing a mediator. Among them are the Legal/ ADR, Corporate, Insurance and Construction fields from private sectors, and the Housing Authority, Financial Dispute Resolution Centre, Joint Mediation Helpline Office and HK Family Welfare Society from the institutional/ special sectors. It is amazing how they may differ in the characteristics they look for in a mediator and the ‘why’ and ‘what’ factors which may affect whom they choose and appoint.

Arbitration in Banking
Based on newly-released empirical findings, Professor Affaki will explore in his lecture the reality of arbitration in banking and financial matters. He will make the case for a differentiated approach according to the particular banking sector where arbitration is contemplated, including derivatives, project finance, advisory banking, sovereign lending, and Islamic finance and offer recommendations that take into account the reality of banking and finance in the wake of the Global Financial Crisis and the risk approach in international banks towards commercial and investment arbitration.

Arbitration laws and rules routinely provide for a mechanism to challenge arbitrators. While challenges to arbitrators are, at least in Hong Kong arbitration, not often sustained, any challenge made will disrupt proceedings, add delay and increase costs. Every arbitrator should, therefore, be keeping pace with the international standards and latest practice relevant to potential conict of interests, duties of disclosure, typical challenge allegations and related procedures.
This training will provide practical and informative insights into the latest developments in this area, with reference to the relevant practice at HKIAC and in Hong Kong-seated arbitration. The participants will also have an opportunity to exchange views with the trainers on practical issues arising from two real-life challenge scenarios.
