HKTDC is piloting a new SME support initiative called “T-box”, short for Transformation Sandbox, a free 3-month programme that helps SMEs upgrade and transform their businesses. Any HK-registered company can apply and choose from our 4 transformation goals: branding, e-commerce, manufacturing/supply chain relocation or new market development. TDC support staff will recommend relevant training workshops, individual advisors, provide market and funding info and help companies access business opportunities.

The international arbitration market had to adapt and evolve rapidly to deal with the challenges presented by the Covid-19 pandemic. Not only is technology increasingly being utilised to facilitate arbitration proceedings, remote and virtual hearings are becoming the “new normal”. One also see the emergence of new forms of commercial and investor-state disputes arising from the passing and implementation of governmental legislation and regulations and increasing invocation of material adverse effect/change clauses.

 

Asia Pacific has been at the forefront of innovation and developments in international arbitration, and will continue to do so. How will the practice of international arbitration in Asia Pacific adapt to the new era of social distancing ushered in by the Covid-19 pandemic, and develop best practices embracing the “new normal” with its diversity in culture, legal systems, languages and traditions? Such innovation and developments shall be discussed and presented in various aspects including:

Increasing international investment, the proliferation of international investment treaties and contracts have contributed to the development of international law that defines obligations between host States and foreign investors and refers to internationalized arbitration procedures for resolving related disputes. The FDI Moot addresses such investment disputes.

 

The 2020 FDI Moot case involves a coal power generation plant that is to be phased out well before its designed operational life. The phase-out is mandated by an instrument issued by the REIO of which Respondent is a Member State. The Claimant is a financial institution that bases its claim on its acquisition of the original financing agreement and related rights through assignment. One of the arbitrators is challenged, inter alia, based on views that he has previously taken on environmental disputes.
