Advocates’ Duties in International Arbitration: Has the time come for a set of norms?

HKIAC is proud to sponsor the 17th Annual IBA International Arbitration Day in Paris, to be held on Thursday, 13th – 14th February 2014. Following the IBA’s recent adoption of its Guidelines on Party Representation in International Arbitration, International standards of conduct amongst Counsel and during arbitration proceedings will be considered. Up to now Counsel have been subject to a variety of rules and standards regarding their conduct in International arbitral proceedings, this will be explored throughout the sessions, questioning whether this diversity leads to unfairness and would a set of common rules be the answer. Also to be discussed will be the question of whether Counsel owe a duty of honesty in relation to their submissions as well as looking at the process of the gathering of evidence, should we seek to level the playing field?
