Online Dispute Resolution: Now and the Future

Online Dispute Resolution is a form of dispute resolution that relies on the internet to resolve disputes. Dispute resolution methods including negotiation, mediation, conciliation and arbitration are gradually evolving to become available online.

As one of the founding offices of the Asian Domain Name Dispute Resolution Center (“ADNDRC”), the Hong Kong International Arbitration Centre (“HKIAC”) has been administering domain name disputes since 2002 and is accommodating users’ needs for more online dispute resolution options.

Resolving Cross-Border IP and Technology Disputes

HKIAC is pleased to co-organise a seminar with Silicon Valley Arbitration & Mediation Centre (SVAMC).  Intellectual property (IP) is central to today’s knowledge economy, but rising disputes can interfere with the effective exploitation and protection of IP rights.  Although IP disputes are traditionally resolved through court litigation, businesses have increasingly turned to mediation, arbitration or other alternative dispute resolution (ADR) procedures, especially in cross border settings.   The Arbitration (Amendment) Bill 2016 clarifying the arbitrability of IP disputes, solidifies Hong Kong’s position as a leading jurisdiction for resolving cross-border IP disputes. Re-Examining the Legal Expert in International Arbitration

Donald Francis Donovan is Co-Head of the International Disputes Group at Debevoise & Plimpton LLP and serves as counsel in international disputes before courts in the United States, international arbitration tribunals, and international courts. He is widely regarded as one of the leading international arbitration practitioners and practicing international lawyers in the world. Mr. Donovan serves as President of the International Council for Commercial Arbitration (ICCA). He recently completed a term as President of the American Society of International Law, and he previously served as Chair of the Institute for Transnational Arbitration (ITA). He teaches International Arbitration and International Investment Law and Arbitration at the New York University School of Law.

ICCA-ASIL Task force on Damages In International Arbitration

In the afternoon of 15 November 2017, the Joint ICCA-ASIL Task Force on Damages in International Arbitration (Task Force), co-chaired by Catherine Amirfar and Gabrielle Nater-Bass, will convene to present its ongoing work to promote consistency and rigor in the quantification of damages in international arbitration. The Task Force, which is comprised of leading legal and economics experts from diverse jurisdictions across the globe, aims to develop a damages tool of practical application.

HKIAC is the first arbitral institution to offer a Tribunal Secretary Training Programme.  As an extension of HKIAC’s tribunal secretary service, the Programme trains the next generation of tribunal secretaries around the world. 

The training typically takes one and a half days, during which part of the participants work will be assessed. A further written exam will follow the training. Participants who successfully pass the written assessment will be interviewed by a member of the Board or Faculty.  Participants who have passed both the written and oral exam will receive a certificate of completion and will be listed on our website subject to his/her consent.
